By accessing or using Silent Menu's services — including our text-based AI ordering system, website, and restaurant dashboard — you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our services.

Description of Service

Silent Menu provides an AI-powered text messaging platform that enables customers to place food orders with participating restaurants via natural language text messages. Our AI interprets your messages, confirms your order, and facilitates payment and pickup.

Eligibility

You must be at least 13 years old to use our services. By using Silent Menu, you represent that you are at least 13 years of age and have the legal capacity to enter into these Terms.

User Conduct

When using our service, you agree not to:

• Submit fraudulent orders or payment information.
• Abuse, harass, or send inappropriate content to the AI system.
• Attempt to manipulate or exploit the AI ordering system.
• Interfere with the operation of our services.
• Use automated systems to send messages to our platform.
• Violate any applicable laws or regulations.

Orders and Payment

• All orders are subject to acceptance by the participating restaurant.
• Menu prices, item availability, and restaurant hours are set by individual restaurants and may change without notice.
• Payment is processed securely through Stripe. By providing payment information, you authorize us to charge the specified amount.
• All prices are displayed in USD and include applicable taxes unless otherwise stated.
• Orders are for pickup only. You are responsible for collecting your order at the designated time and location.

AI Limitations

Our AI system strives to accurately interpret your orders but may occasionally misunderstand complex requests, slang, or ambiguous phrasing. You will always be asked to confirm your order before payment is processed. It is your responsibility to review the order summary and confirm accuracy before completing payment.

Refunds and Cancellations

• Cancellation requests must be made before the restaurant begins preparing your order.
• Refund policies are subject to the participating restaurant's discretion.
• If the AI system causes an incorrect order that you confirmed in good faith, contact us and we will work with the restaurant to resolve the issue.

Messaging Consent

By texting our ordering number, you consent to receive automated text messages related to your order, including confirmations, status updates, and receipts. Message and data rates may apply. You can stop messaging at any time by texting STOP.

Intellectual Property

All content, branding, technology, and intellectual property associated with Silent Menu are owned by Silent Menu, Inc. You may not copy, modify, distribute, or reverse-engineer any part of our platform.

Limitation of Liability

To the maximum extent permitted by law, Silent Menu shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. This includes but is not limited to: incorrect orders, food quality issues, allergic reactions, or missed pickups. Our total liability shall not exceed the amount you paid for the specific order in question.

Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Indemnification

You agree to indemnify and hold harmless Silent Menu, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.

Modifications

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page. Your continued use of our services after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
